The E-3 visa is a pathway for Australian citizens who want to work in the U.S. in specialized occupations. To qualify, the applicant must be an Australian citizen and secure employment in a role that requires at least a bachelor’s degree or its equivalent in the relevant field.
An applicant must first have an E-3 visa issued by the U.S. Department of State at a U.S. Embassy or Consulate. This visa is initially valid for a maximum of two years, but may be extended indefinitely—although each extension is only for two years. Changing to E-3 or the extension of an already held E-3 visa for the persons already in the United States is possible by making an application on Form I-129 with the USCIS.
The documents required to support the E-3 application include:
- Evidence of being a citizen of Australia.
- Letter from the U.S. employer stating the job, its duration, salary and qualification requirements.
- Evidence of meeting education or licensing requirements, including having a bachelor’s degree or equivalent.
- A certified Labor Condition Application filed by the employer with the U.S. Department of Labor.
E-3 visa offers exclusive advantages from other U.S. work visas, which is renewal of the visa provided the person holds non-immigrant intent; and many professionals renew their E-3 visas for several years without problems.
More guidance about how to apply and how to meet all the visa requirements can only be sought from immigration professionals who specialize in this field.
